Individual Non-Commercial License Agreement for ITI Software

ITI is a set of programs for building, maintaining, testing, and depicting decision trees. These programs includes an algorithm known as DMTI, which is part of the ITI system software (SOFTWARE).

ITI is protected by copyright: Copyright (C) June 1997, University of Massachusetts (UMASS). All rights reserved. The SOFTWARE was developed by Paul Utgoff, director of the Machine Learning Laboratory in the Computer Science Department at the University of Massachusetts, Amherst.

Notice: This is a contract. By accepting the SOFTWARE, you (LICENSEE) accept the terms and conditions of this licensing agreement. If LICENSEE does not accept the terms and conditions, then LICENSEE must not accept the SOFTWARE. If at a later time LICENSEE decides not to continue licensing the SOFTWARE under these terms and conditions, then LICENSEE must delete permanently all files constituting the SOFTWARE.

This license grants LICENSEE a non-exclusive license to use the SOFTWARE for internal, non-commercial, research-only purposes. Title to copyright to the ITI SOFTWARE shall at all times remain with UMASS, and LICENSEE agrees to preserve same. The SOFTWARE, in whole or in part, must not be redistributed nor made available in any form by the LICENSEE. LICENSEE must not modify, adapt, translate, rent, lease, loan, resell for profit, distribute, network, or create derivative works based upon the SOFTWARE or any part thereof.

Nothing in this Agreement shall be construed as conferring rights to use in advertising, publicity or otherwise any trademark of UMASS, including the name of "University of Massachusetts" or "UMASS." Nothing in this Agreement shall be construed as conferring rights to any UMASS patents or patent applications other than those rights necessary to use the SOFTWARE under this Agreement.

The SOFTWARE is provided "as is" and UMASS makes no representations or warranties, express or implied. By way of example, but not limitation, umass makes no representations or warranties of merchantability or fitness for any particular purpose or that the use of the licensed software components or documentation will not infringe any patents, copyrights, trademarks or other rights.

UMASS shall not be held liable for any liability nor for any direct, indirect or consequential damages with respect to any claim by LICENSEE or any third party on account of or arising from this Agreement or use of this SOFTWARE.

UMASS's liability to LICENSEE for actual damages for any cause, whatsoever, and regardless of the form of the action, will be limited to the actual price LICENSEE paid UMASS for the SOFTWARE.

This Agreement is effective until terminated. This Agreement will terminate immediately without notice from UMASS if LICENSEE fails to comply with any of its provisions. Upon termination, LICENSEE must destroy the SOFTWARE and all copies thereof, and may terminate this Agreement at any time by doing so.

I (LICENSEE) accept the terms and conditions of this agreement.
